Answers to the most common questions about PF & ESIC compliance in Maharashtra.

Any establishment employing 20 or more persons is mandatorily required to register under the EPF Act, 1952. This includes factories, commercial establishments, mines, plantations, and specified industries. Once registered, the threshold cannot be reduced. Some establishments below 20 employees can also voluntarily register. Certain industries have a lower threshold of 10 employees.
PF contributions must be paid by the 15th of the following month. Delays attract interest at 12% per annum and damages ranging from 5% (delay up to 2 months) to 25% (delay beyond 6 months) on the outstanding amount. Penal damages are calculated separately from the interest and can significantly increase your liability.
Yes. ESIC is applicable to all non-seasonal factories and establishments (including IT companies, BPOs, service sector) employing 10 or more persons, where the wages of employees are ₹21,000 per month or less. Employees earning above this ceiling are exempt from ESIC coverage but the employer still needs to maintain compliance registers and report accordingly.
An employee whose monthly basic wages exceed ₹15,000 at the time of joining is exempt from compulsory EPF membership, but they can voluntarily join the scheme. However, if the employee was previously a PF member and their salary increased above ₹15,000, they must continue contributing and cannot exit the scheme. The employer's mandatory contribution is on the ₹15,000 ceiling amount.

The principal employer is ultimately responsible for ensuring that the contractor has registered and is making statutory contributions for the contract workers. Failure of the contractor does not absolve the principal employer of liability.
